Mail Policy

While all Digital Dynamo accounts include UNLIMITED email POP accounts, we do impose certain restrictions to ensure server reliability and fair usage.

General Mail Limits

Message Limits


All Digital Dynamo accounts are limited to sending 300 emails per hour, per domain. Exceeding this may result in undelivered messages.


Mail Server Checks


If a single IP address checks the mail server more than 30 times per hour, you may receive an “incorrect login” error. To avoid this:

  • Set your mail client to check for new messages no more frequently than every 2 minutes
  • Avoid frequent manual “Send/Receive” requests, which count as server checks

Mailing Lists

Mailing lists can be created via your cPanel interface. However:

  • Mailing lists with over 5,000 recipients must use a Dedicated Server
  • Splitting large lists into smaller ones to bypass limits is not allowed

Throttling Is Mandatory


You are limited to 300 messages per hour. Sending to 600+ recipients at once will fail unless throttled.


Example: Send 1 message every 8 seconds → ~450/hour


Failure to throttle:

  • May impact other sites on the same server
  • May result in temporary account suspension for excessive system resource usage

Off-Peak Only for Large Lists


Mailing lists with over 1,000 recipients may only send during:

  • Weekends (Saturday & Sunday)
  • Weekdays 1:00 AM – 8:00 AM EST

Third-Party Mailing Lists

Mailing lists from external sources are only allowed if:

  • The vendor has a public privacy policy stating email addresses may be sold
  • IP and timestamp logs are maintained for each subscriber
  • No addresses were harvested
  • The list uses a double opt-in method

Double Opt-In Required


Every list must:

  • Have subscribers sign up voluntarily
  • Send a confirmation email requiring a response or link click

Failure to use double opt-in violates our Anti-Spam Policy.

CAN-SPAM Compliance


All mailing list messages must:

  • Include unsubscribe instructions
  • Follow FTC’s CAN-SPAM guidelines

Digital Dynamo – Anti-Spam Policy

Digital Dynamo enforces a Zero Tolerance Policy for SPAM.

We do not permit, and will actively terminate, any account or affiliate that sends unsolicited commercial messages. We cooperate fully with law enforcement to prosecute illegal spammers.

Who This Applies To

This policy applies to:

  • Digital Dynamo (aka “We,” “Us,” “Our”)
  • All Digital Dynamo Affiliates
  • All Customers and Subscribers
  • Any representative, agent, or party associated with the above

What Counts as SPAM

We prohibit any unsolicited communication, including:

  • Email SPAM

  • Social media SPAM (Facebook, Instagram, MySpace)

  • “Spim” (instant messenger SPAM)

  • Craigslist or classified ad SPAM

  • Dating or personals SPAM

  • Newsgroup or comment SPAM

  • Any other digital SPAM method

If a recipient does not already know you, you may not send them messages about Digital Dynamo.

CAN-SPAM Requirements

You must:

  • Use accurate sender info
  • Use truthful subject lines
  • Clearly label messages as ads
  • Include a valid physical address
  • Provide a clear unsubscribe method
  • Honor opt-outs within 10 business days
  • Never sell or transfer unsubscribed emails

Indemnification

If you violate this policy or the CAN-SPAM Act, you agree to indemnify Digital Dynamo for all resulting claims, legal fees, and damages.

We reserve the right to choose our own legal counsel, which will be at your expense.

Incorporation by Reference

This Anti-Spam Policy is part of your agreement with Digital Dynamo. Continued use of our services indicates acceptance of all terms herein, including any updates made publicly on yourdigitaldynamo.com.

Breach and Damages

Accounts found transmitting SPAM will be immediately disabled. If actual damages cannot be reasonably calculated, you agree to pay:

  • $5.00 per message

  • Or actual damages, if calculable

This amount reflects our good faith estimate of potential damage, not a penalty.
